Twitter Sued by Elementus Co-Founder After his Account Was Suspended Following Use of Abusive Language

The popular social network Twitter has just been sued by a data scientist called Geoff Golberg as his account was banned after he used insulting language towards a Twitter bot.

As co-founder of the blockchain analytics platform Elementus, Golberg was banned from his Twitter account in July last year for alleged vulgar language.

Now taking it to the courtroom, Golberg has made it clear that the very presence of the bot account violated the terms of service for the social network. He further adds that he was specifically banned for using the words moron and idiot.

Crypto lawyers Stephen Palley and Preston Byrne of Anderson Kill prepared the case against the social network with the plaintiff seeking damages up to $50,000 as well as a reactivation of his Twitter account.

According to the horses, Golberg is suing the social network for breaching their own contractual agreement with research asserting that Twitter accounts are not free as he argued:

“User data is the currency that all users provide to Twitter for access, and it becomes a valuable asset that Twitter then sells to platform advertisers.”

Just under $40,000 was spent by Golberg to promote various posts on the platform over the course of 10 years.

The claim is very well aware that Twitter “enjoys broad discretion to grant, deny, modify, or revoke permission to moderate content on or use its platform at any time,”. However, Golberg argues that discretion cannot be ‘exercised arbitrarily’. 

As he went on to say:

“That discretion is not unlimited, and under New York law cannot be exercised arbitrarily and in bad faith any more than a ticket seller could sell a baseball fan a ticket to a baseball game, keep the fan’s money, and then deny the fan entry to the ball park simply because the fan happens to root for the visiting team.”
